Agreement to these terms

These Terms of Use (“Terms”) are an agreement between you and Rundle, Inc. (“Rundle,” “we,” “us,” or “our”) governing your use of the Rundle mobile application, website, and related services (collectively, the “Services”).

By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use Rundle. You may use the Services only for yourself and in compliance with applicable law.

You are responsible for the accuracy of information you provide, for keeping your device and sign-in credentials secure, and for activity under your account. Tell us promptly at team@rundle.fit if you suspect unauthorized access. You may not transfer your account to another person.

What Rundle does

Rundle helps you view and organize financial information, understand spending, monitor recurring charges, create budgets, and track goals. Rundle is a technology service—not a bank, broker, investment adviser, accountant, credit counselor, money transmitter, or other financial institution.

Rundle does not hold your funds or initiate transactions. Information in the Services is for general informational and organizational purposes only and is not financial, investment, tax, accounting, or legal advice. You remain responsible for your financial decisions and for confirming important information directly with the relevant financial institution.

Connected accounts and data

If you connect an account, you authorize Rundle and our account-data provider, Plaid, to access and process the financial information you select so we can provide the Services. You represent that you have the right to provide those instructions and connect each account.

Data from financial institutions may be delayed, incomplete, or inaccurate. Rundle is not responsible for a third party's data, availability, security, or decisions. You may disconnect a financial institution at any time, though doing so may limit features that rely on current account data.

Subscriptions and billing

Rundle may offer free and paid features. The price, billing period, trial terms, and included features are shown before purchase. Paid subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, subject to the rules of the applicable app store.

Purchases are processed by Apple or Google and managed through your app-store account. You can cancel or manage a subscription in your app-store settings. Deleting Rundle or deleting financial data does not cancel a subscription. Charges are nonrefundable except as required by law or allowed by the applicable app store. We may change prices or features with notice required by law and app-store rules.

Acceptable use

You agree not to:

  • Use the Services unlawfully, fraudulently, or to harm another person.
  • Access or attempt to access another person's account or data without permission.
  • Interfere with, probe, disrupt, or circumvent the security or operation of the Services.
  • Use automated means to scrape or extract data, or place unreasonable load on the Services, except where applicable law does not allow this restriction.
  • Copy, modify, reverse engineer, distribute, sell, lease, or create derivative works from the Services except as expressly permitted by law or an applicable open-source license.
  • Upload malicious code or content that infringes, misappropriates, or violates another person's rights.

Third-party services

The Services depend on or may link to third-party services, including financial institutions, Plaid, Apple, Google, RevenueCat, and other providers. Your use of a third party's service may be governed by separate terms and privacy policies.

We do not control third-party services and are not responsible for their content, availability, security, or practices. A link or integration does not imply that Rundle endorses every feature, product, or statement of that third party.

Ownership and feedback

Rundle and its licensors own the Services, including the software, design, text, graphics, branding, and other content, except for information you provide and third-party materials. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Services.

You retain ownership of information you provide. You give us the limited rights needed to host, process, display, and use that information to operate and improve the Services. If you send feedback or ideas, you allow us to use them without restriction or compensation to you.

Changes and availability

We may add, change, suspend, or discontinue features, and the Services may occasionally be unavailable. When reasonably possible, we will provide notice before a material change that negatively affects paid features.

We may also update these Terms. We will post the revised Terms and update the effective date. If a material change requires additional notice or consent, we will provide it. Continuing to use the Services after updated Terms take effect means you accept them.

Suspension and termination

You may stop using Rundle at any time. The app's deletion control disconnects linked institutions and deletes specified financial data; subscriptions must be canceled separately through the applicable app store. See our Privacy Policy for details.

We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the Services. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue. Provisions that by their nature should survive termination will continue to apply.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RUNDLE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will always be accurate, complete, secure, uninterrupted, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNDLE AND ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNDLE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID RUNDLE FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Governing law and disputes

Before filing a formal claim, you and Rundle agree to try to resolve the issue informally for 30 days. Send a written description of the dispute to team@rundle.fit. This does not prevent either party from seeking urgent injunctive relief or using small-claims court where eligible.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Any court proceeding must be brought in the state or federal courts located in New York County, New York, unless applicable law gives you the right to bring it elsewhere.
